Agreement to our Legal Terms
We are ZomBrainShop (“Company,” “we,” “us,” “our,” “I,” “me,” “my”)
We operate the store ZomBrainShop (The “Shop,” “Store,” or “Service”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Shop,” “Store,” or “Service”).You can contact me via using the Google Form link at the very bottom of the contract If you have any questions relating to either the Terms and Conditions or just the Shop services in general.These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and ZomBrainShop, concerning your access to and use of the Store. You agree that by accessing the Service, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.ZomBrainShop will always give a 2-week notice on our social accounts. Mainly on our Ko-fi page or on Bluesky.The Shop is intended for users who are at least above the age of 16 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Shop. If you are a minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.We recommend that you print a copy of these Legal Terms for your records.

1. Our service
Our services use third-party sites, like Redbubble, to make our physical products, deliver them (note, they too also use another third-party, like Ups, to deliver them), and also provide an easy payment method.We advise you also read their Terms of Service (TOS) as well before purchasing.
ZomBrainShop, at this time, only provides the designs. We do not make the physical products that Redbubble provides (however, we do decide if our designs will go on those products or be removed).If you have any issues with the site of the third party, we recommend you reach out to their customer support instead of us. If you have any problems from Redbubble, we heavily advise you to reach out to Redbubble customer support to see if you can have your problem resolve or a refund.
We would deeply appreciate it if when you received your products with any defects to informed us as well, with the evidence(s) attached so we may decide on whether we, as a small business, should continue to allow our designs on their site.Moving on from Redbubble to Ko-fi. Ko-fi is a mix of tipping, shop options, and many more. What we offer in our shop is a range from commissions to digital products. Please read each description of items of your choosing to ensure no confusion arise.
Commissioning artwork does fall under digital products, however we will be marking them as service products/goods going forward.Our Ko-fi shop will open and close just like our service will to. When new items or commissions are open, we’ll make a post on our social.
When looking at our services on our Ko-fi, when selecting an item, a Standard Term will be shown. We highly recommend you read that as well before proceeding with the order. Understand we reserve the right to decline any service for any reason.Finally, our last digital products, moving from Ko-fi to now Payhip. Payhip is an online store only holding digital products (in our case anyway). Our digital products range from digital coloring books, electronic books, videos and possibly many more in the future. Our Ko-fi shop and Payhip will have similar items, however, Payhip may have more items than what we offer on our Ko-fi. So please, keep an eye out of what we may offer in the future.Etsy is also an online store just like Payhip but, it will have many range of items possibly holding items from our Ko-fi Shop and our Payhip.ZomBrainShop also host commission auctions from time to time on YCH Commishes.

2. Intellectual property rights
I hold all copyright to my products (artwork, writing, commission, other product I produce even if it is not in my shop) All design are created by me unless stated otherwise.You cannot put my work, even if commissioned, into AI generators, NFTS, CRYPTOS, and other AI Tech. I do not condone it. I do not support it. Please respect my wishes.Modification of/to my work, commissioned or not, is prohibited.Failure to follow and agree to my terms will revoke your rights to the commission work or any of my work. EVEN IF YOU HAVE BOUGHT IT ALREADY. I RESERVE THE RIGHT TO STATE IF YOU CAN USE IT OR NOT IF YOU HAVE DISRESPECTED MY TERMS.COMMISSION ORDERS:
-I have full rights to use commissioned artwork for social media posts, portfolio usage, and promotional usage. Under this, you also agree for me to show a speed-paint, livestream it, or give a sneak peek of my process for public view.-You may use your commission order in any non-commercial use, unless commercial rights have been bought.-When posting a commission order online, all I ask is you credit me (LeeChanDoki).-When purchasing commercial rights for your commission, understand the price may be high.DIGITAL PRODUCTS:
-Resells of my products are not allowed unless permitted by me.-Avoid giving away my products for free.-You may buy for a friend.

3. Products
So far, our only physical products are from Redbubble. We do not control the quality of the product. We recommend if you ever received a defected product or never gotten your product to not only inform us but to contact Redbubble support team right away.Letting us know if the product is not in good condition or never arrived at its destination allows us to determine the future of letting our design continue on their site.Our digital products are hosted on Ko-fi, Payhip and Etsy.From time to time, we may host digital commission auction on YCH Commishes.

4. Purchase and payment
ZomBrainShop uses PayPal and Stripe ONLY. Redbubble have their own payment method along with Payhip and Etsy. On our Ko-fi we accept PayPal and Stripe.When commission us through YCH Commishes we’ll be making an invoice using either PayPal or Stripe.We may use other methods of payment, but a contract will need to be sign along with a homemade invoice created by ZomBrainShop (Please be on high alert, we will not use another method unless deem necessary. We will always use PayPal and Stripe first).

5. Return/refund policy
Digital products from Ko-fi, Payhip, and Etsy cannot be refunded. You may contact Redbubble to have purchases items refunded.Services from Ko-fi cannot be refunded, however you must buy the Cancellation Card item that cost $15 USD in order to cancel our services.Remember. Once a commission has been refunded. YOU MAY NOT USE THAT WORK AT ALL. WE HIGHLY RECOMMEND YOU DELETE THE COMMISSION. The client's reputation with us will be affected. In other words, we have the right to ignore you since you have been labeled untrustworthy in our eyes.

6. Cancellation policy
ZomBrainShop is committed to providing exceptional services in a timely manner. Unfortunately, when a customer cancels without giving enough notice, it prevents another customer from being served. I will always give updates and inform you, the client, when we are nearing the final stages of your commission.Cancellation request
Cancellation requests may be submitted online via DM or by purchasing the cancellation item in our shop. Must pay the fee of $15 USD.If you have any questions or concerns about our cancellation policy, please contact us by filling out our form at the bottom of the Terms and Conditions.

7. Prohibited activities
Reiterating, You may not put my work (commission, non-commission, digital products and writing) into AI generators, NFTS, CRYPTOS, and other AI Tech. I do not condone it. I do not support it. Please respect my wishes. My work, whether they are commissioned or not, may not be used in any bigotry or spread hate.You may not use my work whether they are commissioned for commercial or monetized use unless you have paid a licensing fee or royalty fee. Fees have different costs and will be discussed in private with the client.

8. Contribution license
Fan art or commissioned work we receive or buy gives us the rights to either use it to advertise our shop (such as using the images and modifying them in posts to either showcase new items in our shop or to display an update) or showcase/show off the fan art on our Shop social media.
We do not own your work. We will always credit the artist and link to their social (not all of their socials).

9. Third-party websites and content
We are only responsible to what we post on our Redbubble shop, Ko-fi, Payhip, Etsy and our YCH Commishes page. We are not responsible for what else is posted on the third party site.If you have any issues with any of the third party, we recommend you get in contact with their support.

10. Services management
ZomBrainShop is run by one person. I, Lee Chan, will be handling designs, products, marketing, social media posts, and will create announcement posts from time to time. I’ll also be handling the customer services on Etsy and Ko-fi.Understand, I am busy and will do my best to get to customers when I could.

12. Termination
We can not fully delete your account. Please read the third-party site's Terms of Services when making an account. What we can do is block your actions from interacting with us and our clients the best we can.Termination By You. We’d hate to see you go, but you may leave at your own leisure.If you are supporting us by Ko-fi and have no idea how to stop support payment head to Account Settings -> head down to Subscriptions -> click the three dots, meatball menu (●●●) -> finally, click “Don’t Renew.”Termination By ZomBrainShop. As stated above, we cannot terminate your account. However, we may block your account for any reason, such as violating our terms. We can remove your subscription from our Ko-fi.

13. Modifications to Commission Work
ZomBrainShop does not allow any modification to our work even if it is commission, please refrain from taking my work and using it however you please in any revenue setting unless permission was granted. I only allow my work to be used for personal use by the client and only the client.

14. Corrections
There may be information within our Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information.We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

15. Indemnification
I do not hold any responsibility if you lose the file to your commission work or purchase item. Please refrain from reaching out to me for another copy or replacement (unless we are mutual, acquaintances, or friends). I highly suggest making a folder to hold all of your commission files and purchase items, while also backing them up in a save file to prevent loss.

16. User data
ZomBrainShop will collect data, such as usernames, emails, payment methods, and many other info if needed. HOWEVER, we do not sell that info. We will not give out the info to anyone unless it is a means to warn others of unacceptable actions/behaviors.ZomBrainShop will never ask for personal data such as your name, passwords, or anything that does not correlate to ordering a digital commission. If you feel that you are not speaking with the real ZomBrainShop or feel that something is off, stop communication immediately, and please contact our Tumblr Shop, ZomBrainShop to inform us of the discomfort or uneasiness you feel.For more information about the use of user data, please reread 11. 17. Electronic communications. Transactions. And Signatures
We will always use an invoice payment method. If the invoice payment method is unavailable for you, we would have you go through the process of signing a form and have you read a contract for the payment method you would like to use. If we do not use the payment method you have in mind, please refrain from asking. You will receive a homemade invoice receipt/payment receipt in a PDF format. Signatures will be required.

Anywhere else, that is not confirmed to be us by our site, is fraud, and you should report them to us right away so we may take care of it.
